§ 1 Scope and provider

(1) These General Terms and Conditions (T&Cs) apply to the use of the Discord bot “yurna”, the associated web dashboard and to the conclusion and performance of paid Premium subscriptions. The provider is [Vor- und Nachname], [Straße Hausnummer], [PLZ Ort], Deutschland (hereinafter the “operator”), see Imprint.

(2) The service is a privately run hobby project. Deviating terms of users are not recognised unless the operator expressly agrees to their validity.

§ 2 Description of services

(1) The bot provides Discord servers with functions such as moderation, tickets, an XP and economy system, giveaways, statistics and other modules. Authorised persons can configure the bot for their servers via the dashboard.

(2) The basic functions (“Neumond” plan) are free of charge. Extended functions and higher quotas are reserved for Premium subscriptions (§ 5). The current scope of the plans is shown in the dashboard under “Premium”.

(3) The operator strives for high availability but does not owe any particular level of availability. Maintenance, updates, disruptions at Discord or force majeure may lead to interruptions.

§ 3 Requirements for use and account

(1) Use requires a Discord account. Sign-in to the dashboard takes place via Discord (OAuth2). Discord's Terms of Service and Community Guidelines also apply (https://discord.com/terms, https://discord.com/guidelines).

(2) Only persons with the Discord permission “Manage Server” for a server may invite the bot to that server and configure it there. They are responsible for informing the members of their server about the use of the bot.

(3) Premium subscriptions may only be taken out by persons with full legal capacity or with the consent of their legal representative.

§ 4 Obligations of users, prohibited use

(1) In particular, it is prohibited to

• use the bot or the dashboard for unlawful purposes, harassment, spam, raids or other abuse,
• use the bot or the dashboard to distribute content that violates applicable law or Discord's rules,
• disrupt the bot or the dashboard through automated mass requests, circumvention of quotas or attacks on the infrastructure,
• use the bot or the dashboard to impersonate the operator or other persons.

(2) Content that users create via the bot or the dashboard (e.g. texts, ticket messages, settings) remains their responsibility. The operator may remove such content and temporarily or permanently block users or servers in the event of violations.

§ 5 Premium subscription

Plans and prices

All prices are final prices in euros. Where VAT applies, it is included in the price. A Premium subscription applies to the Discord server for which it was taken out.

Conclusion of the contract

(1) The presentation of the plans in the dashboard is not a binding offer but an invitation to place an order. By completing the payment process with the payment service provider Stripe (button “Subscribe” or “Order with obligation to pay”), you submit a binding offer.

(2) The contract is concluded when the operator activates the subscription for the server; you will receive a confirmation email from Stripe and see it in the dashboard. The language of the contract is German. The contract text is not stored separately; you can view the applicable T&Cs on this page.

Term, renewal, cancellation

(1) Depending on your choice, the subscription runs for one month or one year. It renews automatically for the same period unless it is cancelled before it expires.

(2) The subscription can be cancelled at any time with effect from the end of the current billing period – in the Stripe customer portal via the dashboard (Server → Premium → “Manage subscription”) or by email to [E-Mail-Adresse]. Details under Cancellation. The Premium functions remain available until the end of the paid period; there is no pro-rata refund.

(3) The right of both parties to terminate for good cause remains unaffected.

Payment

(1) Payment is made via Stripe using the payment methods offered there (e.g. credit card, SEPA direct debit, others depending on availability). The amount is due at the beginning of each billing period.

(2) If a payment fails, Stripe will notify you and retry the charge. If payment is not received, the operator may deactivate the Premium functions after the paid period has expired and end the subscription.

Changes to prices and services

(1) The operator may further develop the scope of the plans and replace or adapt individual functions, provided that the core of the service is retained and the change is reasonable for users.

(2) Price changes are announced by email or in the dashboard at least six weeks before they take effect and only apply from the next billing period. If you do not agree with a price increase, you can cancel the subscription before it takes effect.

Right of withdrawal

Consumers have a statutory right of withdrawal. Details and the model withdrawal form can be found in the withdrawal policy.

§ 5a Pokémon packages (user subscriptions)

(1) In addition to premium subscriptions for servers, the operator offers Pokémon packages. A Pokémon package applies to the Discord account it was purchased with (not to a server) and extends the use of the connected Pokémon bot: a higher number of trades per day in the included game groups, a shorter break between two trades and higher limits for saved presets. Without a package, the free tier applies with a limited number of trades per game group and day.

(2) Which packages exist, what they include and what they cost is always shown on the purchase page (yurna.info/pokemon). The offer at the time of ordering applies. All prices are final prices in euros; any VAT is included.

(3) For packages with selectable game groups, you choose the game groups when buying. You can fill free slots (e.g. after switching to a bigger package) right away; a swap of already chosen game groups is scheduled and applies from the next billing period.

(4) The rules for the premium subscription (§ 5) apply accordingly to contract conclusion, term, renewal, cancellation, payment and changes to prices and services. Package switches and cancellation are done in the Stripe customer portal via the purchase page (“Manage subscription”) or by email to [E-Mail-Adresse]. Switching to a bigger package is charged pro rata immediately; switching to a smaller package applies at the end of the current period.

(5) The Pokémon bot is an add-on service. There is no entitlement to a particular availability, to particular Pokémon or to successful trades; the trade rules of the respective server (e.g. bans, minimum account age, trade role) also apply with a package. The package is a right to use the software; no Pokémon or game content is sold. Pokémon and all related trademarks are the property of their respective owners (Nintendo, Creatures, GAME FREAK, The Pokémon Company); the operator is not affiliated with them.

§ 6 Data and deletion

The processing of personal data is described in the privacy policy. Data of a server or account is deleted upon request and after confirmation by the operator; removing the bot from a server does not automatically lead to deletion.

§ 7 Liability

(1) The operator is liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, and under the German Product Liability Act.

(2) In the event of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely), liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.

(3) For free use, the operator is furthermore only liable for intent and gross negligence. For data loss, the operator is only liable to the extent that would also have occurred if users had made regular backups appropriate to the risk.

§ 8 Blocking and termination by the operator

(1) The operator may block access in the event of serious or repeated violations of these T&Cs or Discord's rules. Before a permanent block, a deadline for remedy is set – where reasonable.

(2) The operator may discontinue the free service in whole or in part with four weeks' notice. In this case, running Premium subscriptions are ended at the end of the paid period or refunded pro rata.

§ 9 Changes to these T&Cs

The operator may amend these T&Cs with effect for the future if this is necessary for valid reasons (e.g. changes in the law, new functions, changes at Discord or Stripe) and you are not unreasonably disadvantaged as a result. Changes are announced in the dashboard or by email at least four weeks before they take effect. If you do not object before they take effect or continue to use the service afterwards, the amended T&Cs are deemed accepted; the announcement will point out this consequence. In the event of an objection, the operator may end the contractual relationship at the end of the current billing period.

§ 10 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers whose habitual residence is in another country, mandatory consumer protection provisions of that country remain unaffected.

(2) The operator is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

(3) Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions remains unaffected; the invalid provision is replaced by the statutory provisions.
